Trade-in Trade-Up Promotion
Effective Dates: April 15, 2025 – May 15, 2025
These Terms and Conditions (“Terms”) govern participation in the AXYZ International Trade-Up Promotion (“Promotion”) and are binding upon all participants. By engaging in this Promotion, customers acknowledge and accept the following terms as outlined by AXYZ International.
1. Eligibility
This Promotion is open exclusively to customers located in the United States, United Kingdom, Canada, and Poland.
The Promotion applies only to the purchase of new AXYZ machines. All standard models are eligible, but custom-engineered solutions are excluded from this offer.
2. Trade-In Credit Evaluation
- The value of any trade-in credit will be assessed and determined solely by AXYZ International or its authorized representatives.
- All valuations are subject to review and approval by AXYZ and are final and non-negotiable.
- Once approved, the credit will be applied as a direct discount against the final purchase price of the new machine.
- Trade-in credits have no cash value and may not be redeemed, refunded, or exchanged for monetary compensation.
3. Trade-In Machine Conditions
The condition and location of the trade-in machine must allow for safe, clear, and unobstructed removal from the customer’s premises. This includes—but is not limited to—adequate access routes, safe working conditions, and mechanical readiness for de-installation.
Prior to removal, the customer is fully responsible for preparing the machine for pickup. This includes securely disconnecting utilities (e.g., electrical, pneumatic, or water connections), disassembling where necessary, and packing the machine in a manner that enables safe transport by AXYZ or its designated carrier. If the machine is not properly prepared or if delays occur due to inadequate readiness, the customer will bear all associated costs for additional labor, equipment, or rescheduling.
If AXYZ determines that the trade-in machine is in a state that makes restoration or resale commercially unfeasible, AXYZ retains the right to:
- Dispose of, recycle, or otherwise repurpose the machine at its discretion, including transfer to approved third-party suppliers.
- Reject the trade-in if the condition violates safety standards or poses logistical constraints.
In cases where the cost or complexity of removal exceeds what AXYZ deems fair and standard, AXYZ may: - Request removal of specific machine components (e.g., the control system) by the customer;
- Require that the entire machine be dismantled, removed, and/or disposed of by the customer, entirely at the customer’s own expense.
Failure to meet these removal requirements may void the trade-in eligibility.
4. Limitations & Disclaimers
- This offer cannot be combined with any other promotions, discounts, or incentives unless expressly approved by AXYZ in writing.
- AXYZ reserves the right to amend, suspend, or terminate this Promotion at any time without prior notice, where legally permitted.
- Participation in this Promotion does not guarantee acceptance of any trade-in machine. Final eligibility and valuation decisions rest solely with AXYZ.
5. Governing Law
This Promotion and any related disputes shall be governed by:
- United States: The laws of the State of Ohio, and disputes will be resolved exclusively in Ohio courts.
- United Kingdom: The laws of England and Wales.
- Canada: The laws of the Province of Ontario.
- Poland: The applicable laws of the Republic of Poland.
Each participant agrees to the exclusive jurisdiction of the courts within their respective country or region as defined above.
